Formerly known as the Sailors Civil Relief Act, the Servicemembers Civil Relief Act (SCRA) is a
federal law that provides legal protections to active duty service members. This legislation
gives extra protection if legal or financial transactions affect a military member's ability to
perform their active duty orders.
Creditors, landlords, insurance companies, and other institutions must comply with the SCRA. The
SCRA covers service members' various legal and civil obligations, such as automobile leases,
default judgments, rental agreements, security deposits, evictions, credit card interest rates,
mortgage interest rates, mortgage foreclosure, life and health insurance, and more.
Active duty military members are entitled to a maximum interest rate reduction of six percent annually. This benefit applies to student loans, credit card debt, and loans for personal property like auto loans or monthly mortgages. To receive this particular benefit, military members must notify the lender in writing and provide a written notice about the date they began active duty service.
Active duty service members are legally protected from default judgments in civil proceedings. The court may postpone civil proceedings for at least 90 days. The suing party is required to file an affidavit stating the service member's active duty status before a court can enter a default judgment.
Military personnel like those in the National Guard can't be foreclosed without a court order if they took out a mortgage before entering active duty. This protection doesn't apply if they formally waive their rights to do so and covers the time military personnel are on active duty and an additional year after.
The Servicemembers Civil Relief Act (SCRA) prohibits creditors from repossessing personal property, such as vehicles, from military members without first obtaining a court order. If a service member fails to make monthly payments in violation of their contract, the creditor cannot simply repossess the property. They must file a lawsuit and secure a court order from a judge to proceed with the repossession.
